Privacy policy

This privacy policy applies to this website (nautly.ch). A separate privacy policy applies to the Nautly app: nautly.ch/app/privacy.html.

This site is delivered without a server application and without a user account: on this website we set no cookies, use no web analytics and no tracking tools, and operate no contact form. Contact is made through a mailto: link, which opens your local email program (destination: support@nautly.ch).

The animated nautical chart on this page runs entirely in your browser. It is drawn from a fixed file delivered together with the page; we do not ask for your location in order to do so, and nothing is sent back to us or to third parties.

The controller responsible for the processing of personal data on this website within the meaning of the Swiss Federal Act on Data Protection (FADP) and the EU General Data Protection Regulation (GDPR) is:

2. Hosting and server log files

This website is operated with an external hosting provider. Its servers automatically record technical connection data in server log files when the site is accessed.

Hosting provider: Infomaniak Network SA, Rue Eugène-Marziano 25, 1227 Les Acacias (Geneva), Switzerland. According to the provider’s own statement, it operates its data centres exclusively in Switzerland.

2.1 What data is processed in log files

Typically: IP address, date and time of access, page or file requested (URL) and access status, volume of data transferred, referrer URL, and browser type and version and operating system (user agent). Whether the hosting provider stores the IP address in truncated form has not been confirmed to us; we therefore assume that the IP address is recorded in full in the log files.

2.2 Purpose

Operation, stability and security of the website (delivering the page, diagnosing faults, defending against abusive access), together with an aggregated evaluation of access figures in order to see how often and by which routes the website is accessed. This evaluation takes place without cookies, without combining the data with other sources and without building user profiles; individual persons are not identified in the process.

2.3 Legal basis

CH: overriding private interest in secure and stable operation (Art. 6, Art. 19, conceptually Art. 31 FADP). EU: Art. 6(1)(f) GDPR (legitimate interest).

2.4 Retention period

The retention period for the server log files is determined by the hosting provider. According to its statement they are kept for at least 7 days and deleted as part of an automatic log rotation; a maximum period has not been confirmed to us. Where log data is used in an individual case to investigate a specific security incident, it is deleted once that investigation has been completed.

2.5 Processing on our behalf / disclosure abroad

The hosting provider processes the server data on our behalf (EU: Art. 28 GDPR, data processing agreement; CH: Art. 9 FADP). According to the provider’s statements the servers are located in Switzerland; on that basis, no server data is disclosed to a third country (Art. 16/17 FADP, Art. 44 et seq. GDPR). Seen from the EU, Switzerland is a third country; there is, however, an adequacy decision of the European Commission covering transfers to Switzerland (Art. 45 GDPR), so that no additional safeguards under Art. 46 GDPR are required.

3. Encryption and data security

This website is delivered over HTTPS (TLS); requests made over http:// are redirected to https://. The data transmitted between your browser and the server is therefore encrypted in transit. (Art. 8 FADP / Art. 32 GDPR)

4. Contacting us by email

There is no contact form on this site. If you contact us by email at support@nautly.ch, whether through the mailto: link or directly, we process your email address, your name (where you give it) and the content of your message in order to deal with your enquiry. Legal basis: CH Art. 6/19 FADP; EU Art. 6(1)(b) GDPR (pre-contractual), otherwise Art. 6(1)(f) GDPR. The support@nautly.ch mailbox is operated with our Swiss hosting provider (Infomaniak Network SA, Geneva); according to its statements the emails are stored in Switzerland. We deal with your enquiry until it has been concluded and delete the correspondence no later than 12 months after the last contact, unless statutory retention obligations require otherwise.

5. No cookies, no tracking, no disclosure for advertising purposes

This website sets no cookies, uses no analytics or tracking tools, and does not of its own accord load any third-party content (in particular no externally loaded web fonts, maps, videos or social media plugins) that would transmit your data to third parties. Fonts and images are delivered exclusively from this website. Your data is not passed on for advertising or profiling purposes. For links to third-party offerings and for the banner shown by Safari on iPhone, see section 6.

6. External links (App Store)

This website does not of its own accord load any third-party content. It does, however, contain links that take you to third-party offerings — in particular to the Nautly page on Apple’s App Store. When you click such a link, your browser establishes a connection to the provider concerned, and that provider thereby receives the data technically necessary for the connection (including your IP address). Responsibility for the processing of data on the linked pages lies solely with the respective provider (Apple Inc. or Apple Distribution International Ltd.); that provider’s privacy policy applies. A note on Safari on iPhone. The head of this page contains an entry by which we tell Safari that an app for this website exists on the App Store. Safari may then display a banner about that app of its own accord. The entry is text within the page itself — we load nothing and embed nothing in order to provide it. Whether Safari, in order to display this banner, itself retrieves data from Apple before you click anything is for Apple to determine; we therefore give you no assurance that no connection to Apple is made before your first click.

7. Rights of data subjects

Depending on the law that applies to you, you have in particular the right of access (Art. 25 FADP / Art. 15 GDPR), to rectification (Art. 32(1) FADP / Art. 16 GDPR), to erasure (Art. 32(2)(c) FADP / Art. 17 GDPR), to restriction of processing (Art. 18 GDPR), to data portability (Art. 28 FADP / Art. 20 GDPR) and to object (Art. 21 GDPR). An informal message to support@nautly.ch is enough to exercise them. A reasonable verification of your identity may be necessary.

8. Complaints, reports and supervisory authorities

CH: you may submit a report to the Federal Data Protection and Information Commissioner (FDPIC) (Art. 49(1) FADP), edoeb.admin.ch. EU: you may lodge a complaint with a data protection supervisory authority in the country of your residence, your place of work or the place of the alleged infringement (Art. 77 GDPR).

9. Applicable law

The operator is established in Switzerland; the Swiss Federal Act on Data Protection (FADP) applies. This website and the app presented on it are also addressed to users in the EU. In addition to the FADP we therefore also apply the GDPR (Art. 3(2) GDPR) and have structured this policy according to both sets of rules; where the two provide for different bases, we state both.

10. Changes

We update this privacy policy when the way we process data changes. The version published on this page at any given time applies.
